2. Acceptance of Terms
These Terms & Conditions constitute a legally binding agreement between the buyer and Shipibo Store. Access to and use of shipibostore.com, and in particular the placement of any order, constitutes full, unconditional, and irrevocable acceptance of these Terms. No purchase contract is valid unless the buyer has accepted these Terms at the time of purchase.
We recommend saving or printing a copy of these Terms at the time of purchase. The version in effect at the moment your order is confirmed governs that specific transaction. Updated versions apply only to orders placed after the publication date of the update.
These Terms supersede all prior oral or written representations, warranties, or communications between the parties relating to any subject covered herein.
3. Products — Handmade Nature and Inherent Variations
All products sold by Shipibo Store are authentic, handcrafted artisanal pieces produced by Shipibo-Konibo artisans in the Peruvian Amazon. By completing a purchase, you expressly acknowledge and irrevocably agree to all of the following conditions.
3.1 One size
All garments and textile products sold on shipibostore.com are one size. There are no size variants (S, M, L, XL or equivalent). Product listings display the approximate dimensions in centimeters. It is the buyer’s exclusive responsibility to review these dimensions before purchasing and to determine whether the product is suitable for their intended use. Shipibo Store does not offer exchanges or refunds based on size incompatibility, as size information is provided in full on each product page.
3.2 What “handmade” means for your purchase
Each piece is individual. It is made by hand using traditional Shipibo-Konibo techniques, natural threads, and cotton fabrics that are not manufactured to industrial tolerances. As a result, natural variation is inherent to every item.
Color variation: The actual color of the product may vary by up to one shade from product photographs, due to natural dye variation between batches, differences in ambient lighting during photography, and monitor calibration differences between devices. This variation is inherent to the artisan process and does not constitute a defect.
Embroidery pattern variation: Kené embroidery patterns are executed freehand by individual artisans. Minor differences in pattern arrangement, density, or design details between the photograph and the item received are inherent to handcraft production and do not constitute a defect.
Dimensional variation: Stated dimensions are approximate. Actual measurements may vary by up to ±3 cm from the dimensions listed in the product description. This is inherent to handmade textile production and does not constitute a defect.
Thread and material characteristics: Natural fibers may show slight unevenness, texture differences, knots, or color variation characteristic of hand-embroidery and natural dyeing. These are features of authentic artisan work, not defects.
3.3 Non-defect declaration
None of the characteristics described in Section 3.2 — individually or in combination — constitute a manufacturing defect, a product error, or a failure by Shipibo Store to deliver the contracted product. By purchasing, you irrevocably waive any right to claim a return, refund, or any remedy based solely on these natural variations.
3.4 Product photographs
Photographs on the website are representative of the style, design family, and general appearance of the product. Because each piece is unique, photographs are not exact representations of the specific individual item you will receive. If you require specific photographs of a specific available item before purchasing, contact us at romeo.haux@gmail.com prior to placing your order.
3.5 No custom or made-to-order products
Shipibo Store does not accept custom orders, personalized pieces, or made-to-order requests. All products are sold as described in their listings. Requests for customization, modifications, or special specifications will not be processed.
4. Prices and Currency
All prices are displayed and charged in US Dollars (USD). Currency conversion to your local currency, if applicable, is performed by your bank or payment processor and may involve conversion fees over which Shipibo Store has no control and accepts no responsibility.
Prices may be modified at any time without prior notice. The price applicable to your order is the price confirmed at checkout at the time of purchase. Price changes do not apply retroactively to orders already confirmed.
For Peruvian residents, applicable taxes under the NRUS regime are included in the displayed price.
For international buyers, prices are exclusive of customs duties, import taxes, VAT, and all other fees or levies imposed by the destination country’s authorities. These charges are entirely and exclusively the buyer’s responsibility.
In the event of a pricing error on the website due to a technical or editorial mistake, Shipibo Store reserves the right to cancel the affected order and offer the buyer the option to repurchase at the correct price.
5. Customer Accounts
Buyers may create a customer account on shipibostore.com through the WooCommerce account registration feature. A customer account allows you to view your order history, save your shipping address, and manage your personal details.
You are responsible for maintaining the confidentiality of your account credentials. Shipibo Store is not liable for any loss or damage resulting from unauthorized access to your account due to your failure to keep your credentials secure. You must notify us immediately at romeo.haux@gmail.com if you suspect unauthorized access to your account.
Shipibo Store reserves the right to suspend or delete accounts that are involved in fraudulent activity, abuse of our policies, or prohibited conduct as defined in Section 14.
6. Order Process and Contract Formation
The purchase contract between you and Shipibo Store is formed at the moment you receive the order confirmation email, subject to the conditions in Section 7. The process is as follows.
Step 1 — Browse and select. You add products to your shopping cart. Adding a product to the cart does not constitute a binding order or reserve the item.
Step 2 — Checkout. You complete the checkout form with your personal, shipping, and payment information. By proceeding through checkout, you confirm that all information provided is accurate, complete, and current.
Step 3 — Review and confirm. You review the order summary, total price, and shipping cost before submitting the order. This is the final moment to review and correct your order details.
Step 4 — Payment. You complete payment via Niubiz. Submitting payment is your final and binding commitment to the purchase.
Step 5 — Order confirmation email. This email, sent to the address you provided at checkout, constitutes our acceptance of your order and the formal formation of the purchase contract. If you do not receive a confirmation email within 24 hours of payment, contact us at romeo.haux@gmail.com before assuming the order was processed.
Step 6 — Tax receipt issuance. A boleta de venta is issued in accordance with SUNAT regulations and sent to the email address provided at checkout.
Step 7 — Preparation and dispatch. The order is prepared within 3 to 5 business days of payment confirmation and dispatched via Serpost or DHL depending on the destination and the shipping option selected at checkout.
7. Right to Refuse or Cancel Orders
Shipibo Store expressly reserves the right to refuse, hold, or cancel any order at any stage of processing, without liability beyond a full refund of amounts paid, in the following circumstances: the product is out of stock or unavailable after the order was placed; a pricing error affected the product listing; payment authorization is declined or fails to process; there is reasonable suspicion of fraudulent activity; the delivery address is in a destination to which we cannot ship; the order cannot be lawfully exported under Peruvian or international trade law; or the buyer has previously breached these Terms or engaged in prohibited conduct.
In cases of cancellation where the buyer is not at fault, a full refund of the purchase price and confirmed shipping costs will be issued within 7 business days. Shipibo Store’s liability in such cases is limited strictly to this refund.
8. Buyer’s Responsibility for Accurate Information
You are solely and entirely responsible for providing accurate, complete, and deliverable information at checkout. Shipibo Store will not be liable for any loss, delay, additional cost, or non-delivery resulting from inaccurate or incomplete information provided by the buyer.
Errors in shipping address, contact email, or phone number are the buyer’s sole responsibility. Packages returned to sender due to address errors will not be reshipped at Shipibo Store’s expense. If the buyer chooses not to pay for reshipment, a partial refund equal to the product value minus the original outbound shipping cost may be issued, provided the item is returned to us undamaged and in original condition.
You are responsible for ensuring the product is legally permitted for import into your country. Packages seized, refused, or destroyed by customs authorities do not qualify for refunds of any kind.
9. Payment
Payments are processed exclusively through Niubiz (VisaNet Perú S.A.C.), the payment gateway integrated into our checkout. Niubiz accepts Visa, Mastercard, and American Express cards issued both in Peru and internationally. By submitting payment information, you represent and warrant that you are the authorized holder of the payment method used, that the information provided is accurate and current, and that you have the legal right to use that payment method for this transaction.
Shipibo Store does not store, access, or retain any payment card details. All payment data is handled exclusively within Niubiz’s certified payment environment, under the regulatory oversight of the Superintendencia de Banca, Seguros y AFP (SBS) of Peru.
9.1 Chargebacks and payment disputes
Filing a chargeback or payment dispute with your bank or card issuer without first contacting Shipibo Store to resolve the issue through our established process constitutes a material breach of these Terms. In the event of an unjustified chargeback, Shipibo Store reserves the right to: contest the chargeback with full documentary evidence; pursue recovery of the full order value plus all fees incurred as a result of the chargeback; permanently ban the buyer from making future purchases on shipibostore.com; and pursue all available legal remedies under Peruvian law.
A chargeback is considered unjustified when the product was delivered to the confirmed address, the issue falls within natural handmade variation accepted at purchase, the buyer failed to use our established claims process before initiating a bank dispute, or the chargeback is filed outside the claims window without prior communication to us.
10. Product Availability and Stock
All products are displayed subject to availability. Because our items are handmade in limited quantities, stock can change without notice. Shipibo Store does not guarantee that any product will remain available after you have added it to your cart or even after you have placed an order.
If a product becomes unavailable after your order is confirmed and payment processed, we will notify you by email within 3 business days and issue a full refund. Shipibo Store accepts no liability beyond this refund for inconvenience or alternative purchase costs.
11. Shipping
Shipping terms, costs, estimated delivery times, carrier information, customs responsibility, insurance, and procedures for lost or damaged shipments are governed in full by our Shipping & Returns Policy, available at shipibostore.com/shipping-policy. That Policy is incorporated into these Terms by reference and is equally binding on both parties.
By completing a purchase, you confirm that you have read and accepted the Shipping & Returns Policy in addition to these Terms.
12. Returns and Refunds
Shipibo Store operates a strict no-return, no-refund policy by default, reflecting the handmade and one-of-a-kind nature of our products. Returns and refunds are granted exclusively in the two cases described below. All other situations — including but not limited to change of mind, dissatisfaction with natural variation, size incompatibility, or shipping delays — do not qualify for return or refund under any circumstances.
12.1 The only two cases where a return is accepted
Case 1 — Confirmed manufacturing defect: The item received has a demonstrable structural or manufacturing defect that materially impairs its use and that goes objectively beyond the natural handmade variation described in Section 3. Minor thread texture, color variation within one shade, and dimensional variation within ±3 cm do not qualify as manufacturing defects regardless of the buyer’s subjective assessment.
Case 2 — Wrong item shipped: The item received is a completely different product from the one ordered, meaning Shipibo Store dispatched the wrong item. Minor handmade variation in the correct product category does not constitute a wrong item.
12.2 Conditions that must be met in both cases
The claim must be reported to romeo.haux@gmail.com within 14 calendar days of the confirmed delivery date. The item must be unused, unworn, unwashed, and unaltered. The buyer must provide photographic evidence as detailed in the Shipping & Returns Policy. Shipibo Store’s determination of whether a defect or wrong item claim is valid is final, based on physical inspection of the returned item.
12.3 All other situations are non-refundable
Shipibo Store will not issue returns or refunds for: change of mind or personal preference; natural variation in color, pattern, or dimensions inherent to handmade production; size incompatibility, given that all products are one size and dimensions are stated in the product listing; dissatisfaction with delivery time; items that have been used, worn, washed, or altered after receipt; and any situation not expressly covered by Cases 1 and 2 above.

13. Intellectual Property
13.1 Website content
All content on shipibostore.com — including product photographs, descriptions, text, logos, graphics, layout, and branding — is the exclusive intellectual property of Shipibo Store or its licensed content providers. All rights are reserved under Peruvian Decreto Legislativo 822 and applicable international copyright law. Unauthorized reproduction, copying, distribution, or commercial use is strictly prohibited.
13.2 Shipibo-Konibo Kené designs
The geometric Kené designs of the Shipibo-Konibo people are expressions of indigenous cultural heritage recognized as Patrimonio Cultural de la Nación by the Ministry of Education of Peru (Resolución Ministerial N° 836-2008-ED). The collective intellectual and cultural rights over these designs belong to the Shipibo-Konibo community.
Purchasing a product from Shipibo Store grants you a personal, non-commercial right to use the specific item purchased. It does not grant any right to reproduce, digitize, or commercially exploit any Kené design. It does not grant any right to register any Kené-derived design as a trademark, copyright, or any other intellectual property right in any jurisdiction. Unauthorized commercial exploitation of Shipibo-Konibo Kené designs may violate Peruvian cultural heritage protection laws (Ley 28296) and we actively monitor and enforce these rights.
14. Prohibited Conduct
By using shipibostore.com, you agree not to engage in any of the following. Shipibo Store reserves the right to refuse service, cancel orders, permanently ban users, and pursue all available legal remedies against any party engaged in prohibited conduct.
Placing orders using stolen, fraudulent, or unauthorized payment methods. Filing false, misleading, or unjustified chargebacks or payment disputes. Providing false identity, contact, or shipping information. Reproducing, copying, or commercially using our product designs, photographs, or content without authorization. Attempting to register Kené designs or Shipibo-Konibo cultural symbols as intellectual property in any jurisdiction. Using automated bots or scrapers on the website without written authorization. Attempting to interfere with or compromise the security of our website or servers. Harassing or abusing Shipibo Store staff or the artisan communities whose work we sell. Using shipibostore.com for any purpose that is illegal under Peruvian or international law.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Shipibo Store’s total liability for any claim arising from a purchase is limited to the purchase price actually paid for the specific item that is the subject of the claim. Under no circumstances will our liability exceed this amount.
Shipibo Store is not liable for indirect, incidental, consequential, or punitive damages of any kind, including lost profits, emotional distress, or costs of obtaining substitute products. We are not liable for delays or losses caused by courier companies, customs authorities, or any other factor outside our control once the package has been dispatched. We are not liable for consequences resulting from inaccurate information provided by the buyer. We are not liable for failures or security incidents at Niubiz or any other third-party service provider.
Nothing in these Terms excludes liability that cannot be lawfully excluded, including mandatory statutory consumer rights under Peruvian Law 29571 for buyers in Peru.
16. Consumer Rights — Peru (Ley 29571)
Buyers in Peru retain all statutory rights conferred by the Código de Protección y Defensa del Consumidor (Ley 29571). Nothing in these Terms diminishes or waives any right that cannot be contractually excluded under Peruvian consumer protection law. Peruvian buyers may file a queja or reclamo through our Libro de Reclamaciones at shipibostore.com/libro-de-reclamaciones, or seek resolution through INDECOPI.
17. Force Majeure
Shipibo Store shall not be liable for any failure or delay in performing its obligations where such failure results from causes beyond our reasonable control, including natural disasters, floods, earthquakes, epidemics, government restrictions, customs authority actions, carrier strikes, war, civil unrest, or internet infrastructure failures. In the event of a force majeure event affecting an existing order, we will notify affected customers as soon as practicable and offer extended timelines, a substitute product, or a full refund at our discretion.
18. Governing Law and Jurisdiction
These Terms & Conditions are governed exclusively by the laws of the Republic of Peru. Any dispute arising out of or in connection with these Terms or any purchase made on shipibostore.com shall be submitted to the exclusive jurisdiction of the competent courts of Iquitos, Loreto, Peru, to which both parties irrevocably submit.
For buyers in the European Union or United Kingdom, this jurisdiction clause does not affect mandatory consumer protection rights that apply by law in your country of habitual residence and that cannot be contractually excluded.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from the Terms entirely. The remaining provisions shall continue in full force and effect.
20. Entire Agreement and Amendments
These Terms & Conditions, together with the Privacy Policy (shipibostore.com/privacy-policy) and the Shipping & Returns Policy (shipibostore.com/shipping-policy), constitute the entire agreement between the buyer and Shipibo Store with respect to any purchase, and supersede all prior or contemporaneous representations or agreements of any kind.
Shipibo Store reserves the right to amend these Terms at any time by publishing the updated version at shipibostore.com/terms-and-conditions with a revised effective date. Material amendments will be notified to registered customers by email with at least 15 days advance notice. Amendments do not apply retroactively to orders already confirmed.
